Terms of service

1. Agreement

These terms govern your access to and use of CardMetCare, operated by [LEGAL: legal entity name — review and replace] ("CardMetCare", "we"). By creating an account or using the platform you agree to these terms.

2. Eligibility

You must be at least 18 years old (or have a verifiable guardian under DPDP §9) and legally able to enter into a contract under Indian law.

3. Accounts

  • You are responsible for keeping your credentials confidential.
  • You may not share an individual account with another person.
  • Clinic admins are responsible for managing user access within their tenant.
  • We may suspend or terminate accounts that breach these terms.

4. Plans, billing, and refunds

  • Subscription pricing is published on the pricing page. Larger configurations are quote-based.
  • The Clinic Onboarding tier auto-converts to Starter on day 31 unless cancelled before. Pricing and billing cycle are disclosed at signup.
  • Charges are processed by Razorpay or another third-party processor we engage from time to time. We never store your card number.
  • GST is charged at the rate applicable on the date of invoice. Invoices are GST-compliant and emailed to your registered address.

5. Partner-network orders

When you order from a partner (pharmacy, lab, telehealth) through CardMetCare, the contract for that order is between you and the partner. CardMetCare provides the order surface and retains an 8% platform take-rate on consumer orders. Partner SLAs and dispute resolution are governed by the partner's terms; CardMetCare acts as a good-faith intermediary.

6. Acceptable use

  • Don't use CardMetCare for unlawful, harmful, or fraudulent activity.
  • Don't probe or attack the platform without prior written permission.
  • Don't impersonate another patient, clinician, or partner.
  • Don't upload data that you don't have the right to upload.

7. Health information disclaimer

CardMetCare is a software platform that helps organise care; it is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified clinician for medical decisions. CardMetCare's pattern-detection signals and adherence flags are decision-support, not a clinical verdict.

8. Intellectual property

The CardMetCare platform, brand, and content are owned by CardMetCare. You retain ownership of the data you put into your record. We obtain a limited licence to use that data only as necessary to provide the service.

9. Service availability

We aim for high uptime but do not guarantee an SLA on the public consumer plans. Enterprise contracts include explicit SLA terms.

10. Termination

  • You may close your account at any time from the account settings page.
  • We may terminate accounts that breach these terms, with notice where reasonably practicable.
  • On termination, your record is retained per the privacy policy retention schedule, then deleted or anonymised.

11. Limitation of liability

To the maximum extent permitted under Indian law, our total liability for any claim arising from these terms is capped at the fees you have paid CardMetCare in the twelve (12) months preceding the claim. [LEGAL: liability cap — review and replace]

12. Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of [LEGAL: city — review and replace].

13. Changes

We update these terms from time to time. Material changes are communicated at least 14 days in advance.
